Terms and Conditions

§ 1 General

1. Ferienwohnung Klaus -hereinafter referred to as the landlord- rents 2 holiday apartments in Dorf 50A, 5652 Dienten am Hochkönig, Austria.

2. The rental agreement is concluded between the person seeking accommodation - hereinafter referred to as the tenant - and the landlord through the acceptance of the tenant's binding confirmation (booking).

3. The rental property may only be occupied by the number of people specified in the rental agreement. The landlord reserves the right to charge extra people separately or to reject them.

4. The tenant is obliged to treat the rental property with care. He is liable to the landlord for any damage caused by him and/or his children and/or his guests.

5. The tenant accepts the respective house rules.

6. Pets may only be brought with you with the express written permission of the landlord.


§ 2 Rental agreement

1. The tenant offers the landlord a binding rental agreement by means of a written binding confirmation (email / post).

2. The rental agreement is concluded by the acceptance of the binding commitment of the tenant and the landlord.

3. The tenant is obliged to pay the respective advance payments to the landlord on time and without further request.

4. If the deposit is not paid on time after the rental agreement has been sent, i.e. within 8 days of the rental agreement date (Section 1 of the rental agreement) into the landlord's account, the landlord is entitled to cancel the tenant's reservation after a single unsuccessful reminder. The same applies if further deposits are not paid.

5. In this case, the tenant shall bear the rental loss costs.



§ 3 Payment


1. The bank details will be communicated in the rental agreement/booking.

2. The rental agreement specifies the method of payment for the rental amount and the remaining rental amount. It specifies how the payment must be made.

3. Additional costs (e.g. tourist tax, extra bed, etc.) are specified in the booking and can be paid according to agreement.

4. Additional services that are only agreed and ordered on site between the tenant and the landlord must be paid to the property manager before the keys and deposit are returned.
5. If fees are incurred during the transfer, these will be borne by the tenant. The tenant's name, period and/or booking number must be stated when making the transfer.



§ 4 Deposit

1. The tenant must present his passport or identity card upon arrival if the landlord or on-site manager so requests.

2. The landlord or property manager on site is entitled to demand a deposit of up to 200 euros without prior notice. Alternatively, a passport or identity card can be retained as a deposit.

3. The rental deposit is to be paid to the landlord or the property manager on site upon arrival and before the keys are handed over.

4. The rental deposit will be refunded to the tenant on the day of departure after the keys have been returned.

5. In case of damage caused by the tenant and/or his family members and/or guests during the agreed rental period, the necessary repair costs will be deducted from the rental deposit.

6. If the rental deposit is not sufficient to repair the damage, the additional amount required must be paid by the tenant in cash on site and before departure.


§ 5 Arrival and departure

1. The rental property is generally ready for handover by the landlord from 4:30 p.m. to 8 p.m. on the day of arrival.

2. In the event of a late arrival, the tenant must inform the on-site manager in good time and agree on an acceptable arrangement with him. An earlier arrival must also be agreed with the manager.

3. On the day of departure, the rental property must be vacated by 10 a.m. for cleaning.

4. The tenant must report in good time before departure to inspect the rental property.


§ 6 Cancellation, rebooking, cancellation insurance

1. The tenant is entitled to withdraw from the contract before the start of the rental period. In the event of such withdrawal, the landlord will claim compensation. The exact amount of the compensation corresponds to the cancellation fees. These are:
- up to 94 days before arrival 20%
- up to 31 days before arrival 100%
We recommend taking out travel cancellation insurance!

2. In the event of force majeure (natural disaster, war, strike, official closures, ban on accommodation), the landlord reserves the right to terminate the rental agreement. The rental payments made to the landlord will be refunded by the landlord. This applies from the day on which the event occurred. Previous days will not be refunded. Any further claims are excluded.
Does not apply to travel warnings from other countries, positive Covid test that prohibits entry or entry with quarantine conditions!

3. In the event of unavailability (e.g. double bookings) of the reserved rental property, the landlord reserves the right to offer the tenant another rental property of comparable quality. If the landlord cannot offer a comparable rental property, the landlord will refund the tenant the rental payments made. Any further claims are excluded.

4. The assignment of claims arising from the rental agreement to third parties, including spouses and family members, is excluded.

5. The tenant has the right to provide a replacement tenant who will take over the entire apartment. A processing fee of €100 may be charged for this. Cancellation fees will then not be charged.


§ 7 Information

1. The agent's website contains information and descriptions of the selected rental properties and other information (e.g. event calendar, etc.). However, no guarantee is given as to the accuracy of all information, as this is partly based on information from third parties, e.g. traffic authorities and similar institutions.



§ 8 Defects

1. In case of defects and complaints, the tenant must contact the landlord or the local manager immediately.

2. Notifications of defects after the end of the holiday are excluded.


§ 9 Duty to provide information

Reference to the general local tax per person/night from 15 years, according to Salzburg overnight tax, registration number: 50603-000252-2020



§ 10 Legal

1. German law applies.
2. Place of jurisdiction is 67346 Speyer.
